Texas, like most states has a workers compensation framework. Therefore, you may be able to recover from your employer if you have suffered a workplace injury.

Under this framework, if your employer has workers compensation insurance, your employer cannot be sued by you unless the employer acts or fails to act in such a way as to intentionally cause harm to an employee.

However, employers have the option to not carry workers compensation. This is often times referred to in the industry as Nonsubscribers. They are are called nonsubscribers because they have elected to not subscribe or purchase workers compensation insurance coverage for their employees.

When a company or employer does not carry workers compensation insurance for the benefit of their employees – they may still be liable to their employees when their employees were injured while on the job.
