Medical Spa Injury Lawyers

Medical Spas or Med Spas have exploded across the United States in the past 20 years. However, when you face the notion of a medspa procedure gone wrong – it can be truly gut wrenching.

Rapidly advancing technology has raced forward to provide some amazing non-invasive medical and quasi-medical treatments. There are now hundreds of potential treatments ranging from beauty, pain management and relaxation, rejuvenation and more.

Further medspas often market the the following points:

  • non-invasive treatments
  • little to no downtime or recovery
  • fraction of the cost of a treatment that has historically only been provided by a plastic surgeon
  • No general anesthesia
  • limited local anesthesia
  • No long recovery times.

The allure of easy procedures with no downtime is almost impossible to pass up.

As such, You may look at the before and after photos offered by medspas and think that the treatment you are reviewing is magic that has been translated into science.

However, most if not all of the treatments that a medspa may offer are medical services. The machines that are utilized by a technician are medical devices. Which means, if they are used incorrectly or by someone who is untrained, they can cause serious injury and harm.

Anything that is considered a medical device can only be provided under the direction of a licensed medical doctor. Any treatment you receive at a medspa, is typically under the direction of a medical doctor.

Therefore, if you visit a facility and are treated by nurses or other technicians, they are providing the treatment to you under the guidance of a medical doctor. As such, although the treatments may be represented to you as minor or non-invasive, it does not change the fact that they are medical treatments. They are overseen by a doctor and those treatments have the potential to cause injury. As a result, your treatments may cause you injury.

Although the treatment service lists seem to ever be expanding from injectable fillers and fat dissolving, to lasers, cool plates, radiofrequencies, light spectrum treatments and vacuum treatments; the offerings seem to be endless and ever expanding. However large the list – the potential for harm does not diminish.

Further, injury can occur where a medical device used by a spa has not been properly designed by the original manufacturer, or where the machine is not properly maintained by the spa or where the technician or provider has not been properly trained on how to administer the treatment.
